ADOPT ORDINANCE TO AMEND SEC 117 -1 DEFINITIONS (off - street parking); <br />OF THE CITY CODE <br />CASE OF CITY OF RAMSEY <br />By: Amber G. Miller, Planning Manager <br />Background: <br />In December, the Planning Commission recommended approval of the residential off - street <br />parking ordinance and in January that ordinance was approved by the City Council. As the City <br />Council may recall, upon approval of the ordinance, Staff would draft new definitions to clarify <br />some of the off - street parking items to help ease enforcement and clear up any conflicts due to <br />the new code. <br />Notification: <br />In accordance with State Statute and City Code, the March 4, 2010 public hearing notice for the <br />most recent version of the proposed ordinance was published in the City's official newspaper. <br />Analysis: <br />With the changes to the off - street parking section of the City Code, staff needed to clarify some <br />definitions. Most notably the definition of screening needed to be updated to reflect the two <br />standards now included in the Code. Staff also added a definition of Parking Pad and redefined <br />Driveway, Commercial Vehicle, and Commercial Equipment. City Council requested <br />specifically that we look at the definitions of Commercial Vehicle and Commercial Equipment to <br />make certain they are more understandable to the residents. Attached is the proposed ordinance <br />with amendments. Additions are indicated as underlined; deletions are indicated as a <br />strileugh. The ordinance was introduced on March 23 2010 and is now eligible for <br />adoption. <br />At the March 23 introduction, Councilmember McGlone made three suggestions to the text of <br />the ordinance, they are in italics below. First, changing the definition of commercial equipment <br />slightly to read: A variety of heavy machines, either specifically designed or used for <br />commercial purposes, which perform specific construction or demolition functions, such as <br />hoisting, excavating, hauling, grading, paving, drilling, or pile driving, under power. Trailers, <br />either enclosed or flat -bed, 6x12 or smaller are exempt unless they have a Department of <br />Transportation Certificate or number; trailers used for transport of recreational vehicles and not <br />used for any commercial use are exempt. <br />Second, changing the gross vehicle weight on a motor vehicle to match the State definition of <br />10,001 pounds or more. <br />CASE # ".O$' <br />
