CASE # <br />CONSIDER AMENDMENT TO CHAPTER 2 OF THE <br />HOME RULE CHARTER OF THE CITY OF RAMSEY <br />RELATING TO THE FORM OF GOVERNMENT <br />OF THE CITY <br />By: William K Goodrich, City Attorney <br />Background: <br />The City Council, on Mazch 23, 2010, passed Ordinance No. 10-03 providing for the amendment <br />of Charter Section 2.1 changing the City's form of government from the Council-Manager Plan <br />to the Mayor-Council-Plan (City Administrator). City Ordinance No. 10-03 is attached. As you <br />know, the City is currently operating under the Mayor-Council (City Administrator) form of <br />govemment. <br />The Commission will recall that in 2006, the City Council unanimously adopted a Charter <br />Commission recommended ordinance to amend the City Charter causing the City's form of <br />government to be the Council-Manager Plan effective January 1, 2011. This was done by <br />adoption of Ordinance No. 06-35 which is attached. <br />For your information, Ordinance No. 06-35 was adopted pursuant to the procedures in Minn. <br />Stat. 410.12, Subd. 7 which provides that upon recommendation of the Charter Commission of <br />an amendment by ordinance, and after a public hearing, if the City Council adopts the ordinance <br />unanimously, the Charter is amended. Ordinance No. 10-03 is being presented to the <br />Commission pursuant to Minn. Stat. 410.12, Subd. 5 titled "Amendments proposed by Council." <br />By Ordinance No. 10-03, the City Council is proposing a Charter amendment, which will need to <br />be presented to the. voters at an election if it is to become effective. The Charter Commission's <br />role in this amendment procedure is: <br />"After reviewing the proposed amendment, the charter commission shall approve <br />or reject the proposed amendment or suggest a substitute amendment. The <br />commission shall promptly notify the council of the action taken. On notification <br />of the charter commission's action the council may submit to the people in the <br />same manner as provided in subdivision 4, (the election process) the amendment <br />originally proposed by it or the substitute amendment. The amendment shall <br />become effective only when approved by the voters...". <br />None of the votes taken under the Minn. Stat. 410.12, Subd. 5 amendment process, require the <br />,man;mous approval of either the council or the commission, presumably because the fmal action <br />is dictated by the City's electorate. <br />-17- <br />
