CASE#y~0~ <br />ADOPT ORDINANCE AMENDING CHAPTER 4, SECTION 4.1.1 OF THE RAMSEY <br />CITY CHARTER -PRIMARY ELECTIONS (DATE CHANGE) <br />By: Jo Tbieling, City Clerk <br />Background: <br />On April 13, 2010, City Council introduced an ordinance to amend Chapter 4, Section 4.1.1 of <br />the Ramsey City Charter -Primary Elections. This amendment was necessitated by a change in <br />the date of the State Primary Election. <br />As per Minnesota State Statutes 410.12, Subd. 7, upon recommendation of the Charter <br />Commission, the City Council may enact a Charter amendment by ordinance. The City Council <br />must hold a public hearing and the ordinance is enacted if it receives an affirmative vote of all <br />members of the City Council The Charter amendment shall not become effective until 90 days <br />after passage and publication. <br />The proposed ordinance has been published in its entirety within the public hearing notice and <br />following public hearing, such Ordinance is available for formal adoption. Council held the <br />public hearing on Tuesday, April 27. Not all Councilmembers were present at that meeting; <br />therefore, the ordinance was not eligible for formal adoption. Council scheduled a special <br />meeting for this evening, May 4, to take action on this item. <br />Recommendation: <br />Staff is recommending adoption of the ordinance amending the City's Charter by changing the <br />date of the Primary Election to correspond with that of the Statewide Primary election. <br />Council Action: <br />Motion to waive the City Charter requirement to read the Ordinance aloud and to adopt <br />Ordinance #10-XXX amending the City's Charter Chapter 4, Section 4.1.1 Primary Elections - <br />changing the date of the Primary Election to correspond with that of the Statewide Primary <br />election. <br />Roll Call Vote: Councilmember Dehen <br />Councilmember Elvig <br />Councilmember Jeffrey <br />Councilmember Look <br />Councilmember McGlone <br />Councilmember Wise <br />Mayor Ramsey <br />Reviewed by: <br />City Clerk <br />City Attorney <br />City Administrator: <br />Spec CC: 05/04/10 <br />
