Councilmember Kurak inquired if the Council would have to approve the combining of the two <br />lots. <br /> <br />Community Development Director Frolik replied no. <br /> <br />Mr. Menard stated that the problem with combining the two lots is that someone will probably <br />not be able to pay the price for both properties. <br /> <br />Councilmember Kurak stated that if the properties are sold together, then the accessory structure <br />could be utilized by whoever owns it. <br /> <br />Councilmember Cook inquired as to how old the building was.' <br /> <br />Community Development Director Frolik replied that it is about 20 years old. <br /> <br />Mr. Menard noted that l~e has been paying commercial taxes for 20 years. <br /> <br />Community Development Director Frolik replied that the property has been used for commercial <br />uses for 20 years and property is taxed based on use, not on zoning.. <br /> <br />Councilmember Elivg stated that it seemed that the City was already bending some of the rules <br />on the property thus far and questioned if there was a way to treat this as a unique situation rather <br />then change the zoning in the whole area because it seems that the City might have put him in a <br />box. <br /> <br />City Administrator Norman replied that he did not agree that it was an action by the City 'that <br />created the problem. <br /> <br />Councilmember Cook stated that they have no reason to disbelieve how .the building was <br />constructed and the situation is that the building exists and someone is stuck with it. <br /> <br />Councilmember Kurak stated that she did not understand why'the City should have to <br />accommodate a landowner's use of their property. If Mr. Menard combines the two lots, he has a <br />home on the property. <br /> <br />Councilmember Cook stated that if he had some proof that said that the City did not tell him to <br />build the building on his other parcel and Mr. Menard went ahead and did so anyway that would <br />be a different situation. <br /> <br />Councilmember Elvig stated that someone gave Mr. Menard a permit to build a building without <br />a home. <br /> <br />Comrnunity Development Director Frolik noted that staff has been unable to find any evidence <br />that a permit was issued for the building. <br /> <br />Councilmember Kurak pointed out the fact that Mr. Menard was advised in 1992 by staff'that he <br />needed a conditional use permit to legalize the commercial use of ~he property, but Mr. Menard. <br />did not follow up and apply for the permit. <br /> <br />City Council/March 18, 2003 <br /> Page 5 of 8 <br /> <br />-153- <br /> <br /> <br />
