CASE <br /> <br />Background: <br /> <br />ADOPT ORDINANCE TO VACATE EASEMENTS IN <br />WILDLIFE SANCTUARY ADDITION; <br />CASE OF OAKVgOOD LAND DEVELOPMENT, INC. <br />By: Community Development Director Sylvia Frolik <br /> <br />The City Council recently approved the plat of Wildlife Sanctuary 2nd Addition. Wildlife 2na is a replat <br />of Lots 1, 2 and 3 of Wildlife Sanctuary Addition into 54 urban single family lots. Each of the 3 pre- <br />existing lots in Wildlife Sanctuary contained the standard drainage and utility easements around the <br />perimeter. With the replat of the property, all 54 lots were .designed with the standard drainage and <br />utility easements around the perimeter. The new drainage and utility easements conflict with the pre- <br />existing easements. On March 25, City Council conducted a public, hearing to vacate the pre-existing <br />easements. The following items are enclosed for your information: <br /> <br />a) <br />b) <br />o) <br />d) <br /> <br />Notification: <br /> <br />Site location map <br />Exhibit of underlying easements to be vacated <br />Final plat-of Wildlife Sanctuary 2nd Addition <br />Proposed ordinance <br /> <br />In accordance with State Statute, City Staff attempted to notify persons owning property within 350 feet <br />of the subject property of the March 25 public hearing, <br /> <br />Observations: <br /> <br />In. accordance with the City Charter, the ordinance to vacate the pre-existing easements is now eligible <br />for adoption. <br /> <br />Recommendation: <br /> <br />City Staff recommends adoption of the ordinance to vacate pre-existing easements. <br /> <br />Council Action: <br /> <br />Motion to adopt Ordinance #03-' to vacate certain drainage and utility <br />Sanctuary. <br /> <br /> Roll Call Vote: Councilmember Cook <br /> Councilmember Zimmerman <br /> Councilmember Kurak <br /> Councilmember Strommen <br /> Councilmember Pearson <br /> Councilmember Elvig <br /> Mayor Gamec <br /> <br />easements in Wildlife <br /> <br />Review Checklist: <br /> <br />CC: 04/08/03 <br /> <br />Principal City Engineer <br />City Attorney <br /> <br />-201- <br /> <br /> <br />
