-36-

Mr. Watson pointed out that the soil is sandy, which presents an opportunity for standing water.

Greg Stolic stated he has lived in the area for nine and a half years. He stated they had standing
water before Mr. Watson's development was put in, sometimes for two or three days. He
indicated the road drops off there, and asked if it was connected and the developer brings in fill,
what will happen to the trees.

IVlr. Kangas stated if the Commission could find a way not tO connect to 146th, the developers
would love to hear it, since it has been a problem from the beginning. He indicated it is a tough
grade, but they will meet it if they have to, adding the road will probably be steeper than
preferred.

Sandy Bertzyk, 6001 146th Avenue NW stated she lives across from Mr. Watson. She stated she
has a fieldstone wall to keep the sandy land from eroding., and asked who she needed to work
with to make sure the wall ,,vas not covered when they brought:in the fill.

Chairperson Nixt asked if the wall was entirely on her land.

Ms. Bertzyk indicated it was. She stated that when they built the wall Community Development
Director Frolik told her that any new development would have to meet her level. She added that
the developer has been very good about listening to the neighbors concerns, but she wanted to
bring up her wall for the record.

Mr. Bjerstedt asked if the Commission was planning to make a decision at this time.

Chairperson Nixt indicated he would have to wait and see.

A motion was made by Commissioner Johnson, seconded by Chairperson Nixt to-close the
public hearing on Cases 4 and 5.

Motion carried. Voting Yes: Chairperson Nixt, Commissioners JOhnson, Braa'er, Reeve,
Shepherd and Van Scoy. Voting No: None. Absent: None.
