Estimated annual cost per business would be $250.00. <br />On somewhat of a related topic League-initiated legislation would give cities snow removal <br />authority in uncompleted subdivisions under limited circumstances. The bill, HF 2231 (Rep. <br />Mike Nelson, DFL-Brooklyn Park)/SF 2004 (Sen. Kenneth Kelash, DFL-Minneapolis), has <br />passed through both the House and Senate and is awaiting Governor Pawlenty's signature. <br />The legislation provides that a City may remove snow from unopened or private roads in <br />uncompleted subdivisions containing five or more lots upon finding that the subdivision <br />developer, due to general insolvency or pending foreclosure, is unable-to maintain the roads and <br />that public safety may be jeopardized if school buses, public works vehicles, or authorized <br />emergency vehicles cannot travel on the roads. The legislation also provides immunity from tort <br />claims arising from damage to the roadway as long as it is not the result of negligence. Finally, <br />the bill authorizes the City to impose a reasonable and proportionate charge on all properties <br />within the subdivision for services provided. <br />Recommendation: <br />Proceed with developing maintenance agreement and fee schedule based on discussion with <br />business owners and Committee members. <br />Action: <br />Motion to recommend to Council that Public Works staff develop maintenance agreement with <br />fee schedule and bring back to Public Works Committee for review. <br />Reviewed By: <br />Director of Public Works/Principal City Engineer <br />PW: 04/20/10 <br />
