<br />RESOLUTION N0.94- 28 <br />RESOLUTION APPROVING AN <br />AMENDED JOINT POWERS AGREEMENT <br />FOR THE LOWER RUM RIVER WATERSHED MANAGEMENT ORGANIZATION <br />WHEREAS, Minnesota Laws of 1982, Chapter 509, requires all metropolitan watersheds <br />to organize, either as a joint powers group or as a watershed district; <br />WHEREAS, the Cities of Andover, Anoka, Coon Rapids, and Ramsey, with lands in the <br />lower Rum River watershed, adopted a Joint Powers Agreement in 1985 creating the Lower Rum <br />River Watershed Management Organization, and the four cities have worked cooperatively since <br />said time to manage surface and groundwater concerns in the watershed; <br />WHEREAS, the Minnesota legislature has over the years adopted many new laws <br />mandating the organization to perform additional duties and to be responsible for public concerns <br />relating to surface and groundwater, and in 1990 adopted major changes in legislation known as <br />the "Metropolitan Surface Water Management Act," renumbered state statutes, and directed the <br />Board of Water and Soil Resources to promulgate new rules regarding water management <br />organizations; <br />WHEREAS, the new state rules became effective August 1, 1993, and directed all joint <br />powers water management organizations to amend theirjoint powers agreements to be consistent <br />with the new state laws and Board of Water and Soil Resources rules; and <br />WHEREAS, the Lower Rum River Watershed Management Organization has prepared a <br />revised joint powers agreement to comply with state mandates and state law, and the organization <br />has reviewed and recommended that each member city approve the new Joint Powers <br />Agreement. <br />NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Anoka that the <br />Mayor and City Manager are hereby authorized and directed to execute the attached Amended <br />Joint Powers Agreement which will continue the Lower Rum River Watershed Management <br />Organization with powers and duties as expressed therein and consistent with state statutes and <br />rules of the Board of Water and Soil Resources. <br />Adopted this 2nd day of May, 1994. <br />ATTEST: ~~ /~ <br />Peter M.
