He pointed out the JPA <br />does not prevent member cities from using the court system to arrive at an equitable <br />solution. <br />Jankowski stated he will met with the Ramsey Attorney and pursue that avenue. <br />Not available; placed on April 20, 1995 agenda. <br />NEW BUSINESS <br />LRRWMO Permit #95-1 - Kuiken -Certificate of Exemption <br />Jankowski noted that Beduhn is recommending approval of a Certificate of Exemption #3 <br />for Dick Kuiken indicating exemption allows property owner to comply with restoration <br />dated 10-26-94 and modified on i-20-94 for creation of a 3-foot deep ditch along CSAH #78 <br />and return of ditch in middle of property to original grade. Also, all spoil material is to be <br />removed and site returned to original grade. <br />Motion by Weaver, seconded by Ferguson, to authorize the issuance of a Certificate of <br />Exemption as recommended by Barr Engineering. Vote: 4 ayes, 0 nays. Motion carried. <br />Consensus was reached to request that Beduhn also provide a written memorandum <br />regarding his recommendation for approval of a Certificate of Exemption. <br />DNR Request for Comment -Coon Rapids <br />Ferguson reported there has been no action on this project and questioned the need for a <br />LRRWMO permit. Jankowski indicated that a permit is required if the project is to be <br />reviewed by the LRRWMO. A permit is also required for a Certificate of Exemption. <br />The LRRWMO concurred that Coon Rapids should submit a permit and fee so it can be <br />submitted to Beduhn for his review and comments, and consideration of whether it would <br />be eligible for an exemption. <br />Ferguson stated he will submit a permit application for consideration at the April 20, 1995 <br />meeting. <br />LRRWMO Permit #95-2 - Ramse~E]ementary School <br />Jankowski explained this project involves and expansion of the Ramsey Elementary School. <br />He advised that the runoff will ultimately be discharged into County Ditch 47. He reported <br />that this information has been submitted to Beduhn for review and will be on the April 20, <br />1995 agenda. <br />
