No county,
city, or town land use control shall permit
development which has not been approved by the
council, nor shall any county, city, or town
sanction or approve any subdivision, permit,
license, or other authorization which would allow
development to occur which has not been approved
by the council. The council shall not approve
actions which would jeopardize the availability of
a site for use as a solid waste facility."
Moreover, Minn. Stat. § 473.811 subd. 4(a) provides in part:
"Ordinances of counties and local government units
related to or affecting waste management shall
embody plans, policies, rules and standards and
requirements adopted by any state agency
authorized to manage or plan for or regulate the
management of waste and waste management plans
adopted by the council and shall be consistent
with the county master plans approved by the
council."
The proposed airport development interferes with the site
selection process involving Site P and it conflicts with
metropolitan solid waste policies and plans for the both the
expansion and the ultimate development of Site P. The Draft EID
does not explain how proceeding with the project in violation of
these state laws can be justified or lawfully permitted.
4. The Draft EID does not address the fact that an airport
use could not lawfully prevent the development of Site P as a
future landfill.
As a matter of state law, expansion of the airport cannot
prevent Anoka County from operating Site P as a landfill if Site
P is selected and acquired for a future landfill and the
Metropolitan Council issues a certificate of need for the new
landfill. Minn. Stat. § 473.811 subd. 4(a) (1986) provides in
relevant part:
9-9
