6. Obviously, the courts would have to determine whether there was a <br />compensable taking if legal action were brought by WMMI. Since <br />WMMI has no assurance that it, in fact, would be the landfill <br />operator of a new Site P landfill, it is doubtful that a "taking" <br />would exist. Further, the proposed Site P has reasonable and <br />higher alternative land uses so again a taking would be doubtful. <br />With respect to existing landfill expansion, no final approvals <br />have been granted. The City would have the right to restrict <br />development of future uses through a number of lawful means. No <br />additional costs regarding landfill issues are attributable to <br />this project. <br />7. The draft specifically reviews alternative sites and discusses why <br />these no longer are options. The original airport site was <br />approved in 1971 and is currently included in national, state and <br />regional aviation system plans. <br />9-22 <br />
