"16. AIRPORT HAZARDS. Airport hazards have a substantial adverse
effect upon the safe and efficient use of the airport by
aircraft and upon the safety of persons and property located on
or near the airport. The term object as used in the following
paragraphs includes, but is not limited to, above ground
structures, people, equipment, vehicles, aircraft, natural
growth, and terrain."
"The following objects are airport hazards and must be removed"
(cessation of use may constitute removal) - parenthetical added.
"i. Garbage dumps or landfills located within 5,000 feet
' (1500 m) of a non -turbojet runway or 10,000 (3000 m) of a
turbojet runway that may attract birds on or around an
airport."
"18. ZONING AND LAND USE COMPATIBILITY
A. Land Use. Unconstrained use of land adjacent to or in the
immediate vicinity of the airport can directly affect the
efficiency and capacity of the airport. Airport authorities
should:
' (1) Prevent the construction, erection, alteration, or
growth of any structure, tree, or other object in the
approach areas of the runway or the airport, which would
' constitute an airport hazard; and
(2) Restrict the use of land adjacent to or in the immediate
' vicinity of the airport to activities and purposes
compatible with normal airport operations including
landing and takeoff of aircraft.
This may be accomplished by acquiring and retaining ease-
ments, other interest, or rights for the use of land and
airspace; or by adopting and enforcing zoning regulations."
MR7035.160 addresses prohibited areas for landfill sites,
among which are locations considered hazardous because of the
proximity of airports.
Chapter 326 Subd. 3 and Chapter 360.061 to 360.074, laws of
Minnesota provide a basis for airport zoning.
RECOMMENDATION:
No change in Zoning Ordinance or plan is required.
Adoption of airport zoning ordinance by the City of Ramsey does not
Ipermit development to occur and thus is not in conflict with statutes.
Metropolitan Council's approval is not required for airport zoning,
however, the airport is identified in MC's Aviation System Plan as well
as state and national plans.
'.
' 3
9-26
