Replacement housing payments for tenants of more than 90 days and owner -occupants of less than 180 days but more than 90 days are limited to $4,000. This payment may cover the increased cost of renting reasonable, comparable, decent, safe and sanitary housing or it may be used as a down payment on the purchase of replace- ment housing. Similar benefits are available to businesses, farms and non- profit organizations that are displaced. Moving costs, search expenses, and any actual direct losses of tangible personal property may be eligible items of assistance. Title III of the act is intended to encourage the acquisition of real property by agreements with owners in order to avoid litiga- tion costs and delays. It is also intended to assure consistent treatment for owners in Federal programs and to promote public confidence in Federal land acquisition practices. Briefly, some of the major provisions of this title are: o Every reasonable effort shall be made to acquire real property by negotiations. o The property will be appraised before the start of negotiations. o The property owner or his representative may accompany the appraiser during his inspection of the property. o After all appraisals have been made, the acquiring agency will determine what it feels to be just compensation. This amount is not to be less than the agency's approved appraisal. This amount will be promptly offered to the owner. o Until the owner has been paid the agreed purchase price or until funds have been deposited with the court, the owner cannot be forced to move. Summary The proposed action will involve the acquisition in fee simple of approximately 230 acres for Gateway North Industrial Airport. In addition, approximately one acre of avigation easements will be acquired. A total of 19 houses and two commercial establishments on these lands will be purchased. Relocation assistance may be required for an additional six business operations. 2-33
