Replacement housing payments for tenants of more than 90 days and <br />owner -occupants of less than 180 days but more than 90 days are <br />limited to $4,000. This payment may cover the increased cost of <br />renting reasonable, comparable, decent, safe and sanitary housing <br />or it may be used as a down payment on the purchase of replace- <br />ment housing. <br />Similar benefits are available to businesses, farms and non- <br />profit organizations that are displaced. Moving costs, search <br />expenses, and any actual direct losses of tangible personal <br />property may be eligible items of assistance. <br />Title III of the act is intended to encourage the acquisition of <br />real property by agreements with owners in order to avoid litiga- <br />tion costs and delays. It is also intended to assure consistent <br />treatment for owners in Federal programs and to promote public <br />confidence in Federal land acquisition practices. <br />Briefly, some of the major provisions of this title are: <br />o Every reasonable effort shall be made to acquire real <br />property by negotiations. <br />o The property will be appraised before the start of <br />negotiations. <br />o The property owner or his representative may accompany the <br />appraiser during his inspection of the property. <br />o After all appraisals have been made, the acquiring agency <br />will determine what it feels to be just compensation. <br />This amount is not to be less than the agency's approved <br />appraisal. This amount will be promptly offered to the <br />owner. <br />o Until the owner has been paid the agreed purchase price or <br />until funds have been deposited with the court, the owner <br />cannot be forced to move. <br />Summary <br />The proposed action will involve the acquisition in fee simple of <br />approximately 230 acres for Gateway North Industrial Airport. In <br />addition, approximately one acre of avigation easements will be <br />acquired. A total of 19 houses and two commercial establishments <br />on these lands will be purchased. Relocation assistance may be <br />required for an additional six business operations. <br />2-33 <br />
