1/31/79 AC 150/5900-1B <br />d. Rev Personnel. Sponsors may consider specifying in the contract the <br />names of the key personnel who will be working on the project. This can <br />prevent unexpected personnel changes and can help to improve study <br />continuity. The sponsor may also retain authority to review and approve any <br />changes in the key personnel or to terminate the project in the event the <br />contractor changes key personnel. <br />35. CONTRACT REVIEW AND APPROVAL. Preaward review and/or approval by the <br />FAA of sponsor proposed contracts is not required except under certain <br />conditions. However, sponsors may wish to submit all such contracts to the <br />FAA for review to insure that necessary work elements and contract provisions <br />have been incorporated. Deficiencies in the contract could cause costs <br />associated with the project to become ineligible for Federal assistance. <br />Circumstances requiring FAA review and approval prior to award are as <br />follows: <br />a. Proposed contracts of sponsors who are undertaking their first DOT <br />grant and whose procurement standards have not been reviewed or sponsors <br />whose procurement standards have been reviewed and found to be deficient. <br />b. The proposed contract is to be awarded on a sole source basis or <br />where only one bid or proposal is received in which the aggregate expenditure <br />exceeds $10,000. <br />c. The proposed contract is to be awarded to other than the low bidder <br />under a formally advertised procurement. <br />d. Proposed contracts which are of special interest to DOT, proposed <br />contracts which are considered sensitive and may be subject to close <br />scrutiny by the public, and those which are unique and require special <br />evaluation. A copy of all executed contracts should be provided to FAA along <br />with documents outlined in paragraph 36. <br />36. TECHNICAL AND COST ANALYSES. Sponsors are required to perform a <br />technical analysis of every contract and a cost analysis of negotiated <br />contracts or contract modifications. Copies of these technical and cost <br />analyses should be provided to the FAA along with the proposed contract, if <br />the proposed contract is subject to FAA review and approval. When the <br />contract is not subject to prior review and approval, the technical and <br />cost analyses should be submitted to the FAA with copies of the executed <br />contract. <br />37. PURCHASE OF EQUIPMENT. In general, the purchase of property or equip- <br />ment shall not be included in a planning grant. However, under, certain <br />circumstances, specialized equipment or materials may be approved if directly <br />required for completing elements of the planning study. In the event of such <br />an approval, the property management standards specified in FAR Part 152 <br />and included as Appendix 3 of AC 150/5100-10 shall be complied with as <br />applicable. <br />Chap 3 <br />Par 34 <br />21 <br />
