• <br />• <br />) <br />on parcels valued in excess of $1,000 when the prop- <br />erties are of a complex or unusual nature or when- <br />ever the appraised value is expected to exceed <br />$50,000, and in the cost of up to two additional <br />appraisals in condemnation cases when litigation is <br />imminent and deemed necessary by the Sponsor. <br />Federal participation may be allowed in the cost <br />of more than the number of appraisals provided for <br />above when: <br />(1) Additional appraisals have been requested by <br />FAA, or <br />(2) When the Sponsor, in special or unusual cir- <br />cumstances, has requested and received prior <br />approval for Federal participation in the cost <br />of additional appraisals. Requests and ap- <br />provals may be on specific parcels or on a <br />project basis covering specific types of ac- <br />quisitions. Approval will be given only on the <br />basis that such expenditure is in the public <br />interest. <br />28. APPRAISER QUALIFICATIONS. The <br />appraisals prepared for use in ADAP/FAAP proj- <br />ects are to be prepared by staff or fee appraisers ade- <br />quately qualified as to education, experience and <br />credentials for the property being appraised. The <br />appraiser will have no personal interest, present or <br />prospective, in the property being appraised. <br />a. Qualifications. The Sponsor is expected to <br />establish qualifications required of all appraisers <br />and reviewing appraisers used by it to appraise or <br />review appraisals of real property to be acquired <br />for ADAP/FAAP projects in which Federal funds <br />will participate in any part of the cost of the <br />project. <br />b. Fee Appraisers. The Sponsor should secure <br />only appraisers that are qualified for the particular <br />job to be done. It is necessary for the appraiser's <br />ability to be evaluated on an individual basis. In ad- <br />dition to having minimal education and experience <br />qualifications, fee appraisers should have verified <br />specific appraisal experience in the type of property <br />they are employed to appraise. <br />c. Reviewing Appraiser. A reviewing appraiser <br />should be the best qualified. Every reviewing ap- <br />praiser is to have knowledge of the principles and <br />techniques pertinent to appraising and the ability <br />to independently appraise properties of the type for <br />which he is to review appraisal reports by others. <br />Where a Sponsor does not employ qualified review <br />appraisers on its staff, the Sponsor should hire a fee <br />review appraiser. <br />29. APPRAISAL FEES, CONTRACTS AND <br />AGREEMENTS. <br />a. Employment of Fee Appraisers and Specialists. <br />The FAA will participate in the cost of employing <br />fee appraisers and specialists to provide cost studies, <br />estimates or appraisals under ADAP/FAAP when: <br />(1) The Sponsor determines that such employ- <br />ment is necessary to efficiently complete the <br />project. <br />A fee appraisal or specialist report is needed <br />for use in a condemnation case. <br />The unusual character of the work requires <br />the services of a person or persons with <br />highly specialized knowledge and experience <br />not available on the Sponsor's staff. <br />b. Fees. Appraisal fees will be determined by the <br />following: <br />(1) The basis of payment set forth in the agree- <br />ment covering more than one parcel will <br />not be computed on an average rate per <br />parcel. The agreement will itemize the actual <br />amount to be paid per parcel or such item- <br />ization should be by a separate statement. <br />(2) Provision should be made in the agreement <br />for a per diem rate to be paid to the fee <br />appraiser or specialist in the event court ap- <br />pearances or conferences preparatory thereto <br />become necessary. This contingent cost will <br />be separate and apart from the fee or the <br />overall limit specified in the agreement for <br />completion of the services covered by the <br />agreement. <br />There will be no Federal reimbursement <br />for compensation paid by an acquiring <br />agency for revision or correction of a report <br />required by the appraiser's or specialist's fail- <br />ure to comply with contract specifications <br />and standards in the agreement. <br />(4) There will be no Federal participation in the <br />appraisal or specialist fee where the fee is <br />determined as a percentage of the appraised <br />or assessed value, nor will sole consideration <br />be given to the appraised value in such ap- <br />praisal when considering the reasonable ac- <br />quisition cost. <br />The amount of the fee will represent a fair <br />payment for the services performed whether <br />it be for the initial valuation, a new valua- <br />tion occasioned by a change in the taking, or <br />a subsequent updating requested by the <br />Sponsor.
