RECOMMENDATION: <br />The City should review the existing uses in Zone B and determine <br />whether certain types of use on undeveloped lots should be prohibited <br />from Zone B. <br />RESPONSE TO MR. PETTIT'S (TOM THUMB) CONCERNS: <br />Mr. Pettit's understanding that their store no longer could exist if <br />the Zoning Ordinance is adopted is erroneous. All uses currently <br />existing in Zone A would be "grandfathered" in and could be continued. <br />At the time when the use or land would be acquired, the owner is <br />entitled to receive fair market value for the property. The proce- <br />dures for acquisition must meet the federal requirements of the "Uni- <br />form Relocation Assistance and Real Property Acquisition Policies Act" <br />of 1970. FAA's Advisory Circular 150/5100-11 provides guidance and <br />information which address the procedures, rights of property owners, <br />relocation assistance, etc. Copies of this AC have been ordered and <br />will be made available to each of the affected property owners at the <br />appropriate time. Relocation and moving expenses are eligible items <br />under the acquisition program. <br />The City had expressed its intent to fund acquisition and eligible <br />improvements through the use of Airport Improvement Program (AIP) <br />Funds providing up to 90% funding. The remaining 10% would be fi- <br />nanced from the City through a number of means. These may include <br />accumulated funds, tax increment funds, general funds, bonds or com- <br />binations of these mechanisms. <br />Obviously, <br />interested <br />existing. <br />businesses <br />businesses are an asset to the Community and the City is <br />not only in new businesses but in retaining those which are <br />To that end, the City can be expected to work with both <br />and residents for the common good. <br />RECOMMENDATION: <br />No changes are required to zoning plans or the Zoning Ordinance.
