State and Federal <br />A wetlands alteration permit (changing course, current or <br />cross section of protected waters) may be required from the <br />Minnesota Department of Natural Resources and possibly the <br />Corps of Engineers (Section 308 permit) for the relocation <br />of CSAH 116 near a wetland area and for discharge of <br />stormwater drainage. Preliminary assessment indicates that <br />the roadway relocation will be outside of the wetland area. <br />Further preliminary engineering may indicate that the wet- <br />land will be marginally impacted. In either event, it <br />appears impacts can be minimized or mitigated through sound <br />engineering and construction practices. <br />1. All work or discharges to the wetland resulting <br />from permitted construction activities, must meet <br />applicable Federal, State, and local water quality and <br />effluent standards on a continuing basis. <br />2. Measures would be adopted to prevent potential <br />pollutants from entering the watercourse. Construction <br />materials and debris, including fuels, oil, and ohter <br />liquid substances, will not be stored in the construction <br />area in a manner that would allow them to enter the <br />watercourse as a result of spillage, natural runoff, or <br />flooding. <br />3. If excavated or fill material was placed on an <br />upland disposal site (above the ordinary high-water mark), <br />the site would be securely diked or contained by some other <br />acceptable method that prevents the return of potentially <br />polluting materials to the watercourse by surface runoff or <br />by leaching. <br />4. All exposed slopes, fills, and disturbed areas <br />resulting from activities authorized by this permit, would <br />be given sufficient protection by appropriate means such as <br />landscaping, or planting and maintaining vegetative cover <br />to prevent subsequent erosion. <br />5. All fill (including riprap), if authorized under <br />this permit, would consist of suitable material free from <br />toxic pollutants in other than trace quantities. <br />6. A contingency plan would be formulated to be <br />immediately effective in the event of a spill. This <br />requirement is particularly applicable in operations <br />involving the handling of petroleum products. In addition, <br />the Corps or DNR may specify special conditions for the <br />work including mitigation through enhancement of an <br />appropriate wetland. <br />2-51 <br />
