Councilmember introduced the following resolution and moved for its adoption: RESOLUTION NO. 03-04- A RESOLUTION APPROVING THE ISSUANCE OF A GRADING PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO IMPORT SOILS WHEREAS, the Ramsey City Council adopted Resolution No. 03-04-__ adopting Findings of Fact #__ for this use and herein approves the Grading Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On April 22, 2003, a Grading Permit ("Permit") was issued by the City of Ramsey ('.'City") to LTR Land Development Inc. ("Permittee") for grading and importing soils to the property legally described as follows: That part of Government Lot 3 in Section 26, Township 32, Range 25, Anoka County, Minnesota, lying northerly of the plats of Chestnut Hill 4th Addition and Chestnut Hill 5th Addition, and southerly of the plat of Sunfish Lake Estates. And that part of Government Lot 2 in Section 26, Township 32-, Range 25, Anoka County, Minnesota, lying southerly and southeasterly of the following described line: Beginning at the point of intersection of the east line of said Government Lot 2 with the center line of Sunwood Drive NW per Document No. 1226775, as recorded at the Anoka County Recorder's Office; thence westerly along said center line to the intersection with the easterly extension of the north line of Sunfish Lake Estates, according to the recorded plat thereof, Anoka County, Minnesota; thence westerly along said northerly line extended to the most easterly comer of said Sunfish Lake Estates; thence southwesterly along the easterly line of said Sunfish Lake Estates to the south line of said Government Lot 2 and there terminating. ("Subject Property") This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The conditions of this permit are as follows: 1. This permit shall expire on September 30, 2003. All access roads to and from the Subject Property, shall be maintained in order to minimize dust. This shall include periodic sweeping as determined necessary by the City Engineer to remove accumulation of material which may result from spillage and tracking from construction vehicles onto adjacent public roadways. -225-
