Attachment G <br />Councihnember ' introduced the following resolution and moved for its adoption: <br />RESOLUTION #10-06-XXX <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br />PERMIT TO DORIS GRIEP, EL GATO CON BOTAS LEARNING CENTER, <br />ALLOWING THE OPERATION OF A DAYCARE FACILITY ON THE PROPERTY <br />LOCATED AT 5400140 AVE NW, BASED ON FINDINGS OF FACT #_; <br />AND DECLARING TERMS OF SAME. <br />WHEREAS, Doris Crriep, hereinafter referred to as "Permittee," properly applied to the <br />City of Ramsey (the "City") for a Conditional Use Permit (the "Permit") to operate a daycare. <br />facility on the property generally known as 5400 140' Avenue NW and legally described as <br />follows: <br />That part of Lot 1, Block 1 Mallard Ponds 2"d Addition lying within the Northwest <br />Quarter of the Northwest Quarter of Section 36, Township 32, Range 25, subject to <br />easement of record, Anoka County, Minnesota <br />(the "Subject Property") <br />WHEREAS, the Planning Commission met on June 3, 2010, conducted a public <br />hearing pursuant to Section 117-51(b)(3) of the Ramsey City Code and recommended that <br />City Council approve the request for a Conditional Use Permit. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />This Permit is issued pursuant to Section 117-51(b)(3) of the Ramsey City Code. The <br />conditions of this Permit are as follows: <br />1) That the Permittee shall be allowed to operate a daycare facility on the Subject <br />Property; as shown on the site plan dated March 24, 2010 prepared by Platinum <br />Designs, herein attached as Exhibit A, effective upon the date of City Council <br />approval. <br />2) That the Permittee shall adhere to all applicable State Building and State Fire Codes <br />regarding the operation of a daycare facility. <br />3) That the Permittee shall adhere to all State Daycare Licensing Requirements. <br />4) That the Permittee shall install or have installed both a fire suppression system in the <br />unit and a fence for the outdoor play area prior to opening for business.- <br />5) That the Permittee shall be responsible for obtaining all necessary permits prior to <br />fence installation or building modifications. <br />12 <br />
