CASE # <br />Public Hearing <br />REQUEST FOR A CONDITIONAL USE PERMIT TO OPERATE A <br />DAYCARE IN THE B-1 GENERAL BUSINESS DISTRICT <br />Case of El Gato con Botas Learning Center, Doris Griep <br />By: Jessica L. Hendricks, Management Intern <br />Background: <br />On May 13, 2010 the City received a request from Doris Griep, owner of El Gato con Botas <br />Learning Center, for a conditional use pemut (CUP) to operate a daycaze/preschool in the <br />Planned Unit Development (PUD) District at the property generally known as 5400 140a' <br />Avenue NW. <br />Notification: <br />In accordance with State Statute, staff attempted to notify all property owners within 350 feet of <br />the subject property of the request via standard US Mail <br />Observations: <br />T.he Applicant is proposing to .create a Spanish immersion preschool/daycaze called El Gato con <br />Botas Learning Center for children ages three (3) to five (5) years. The proposed hours of <br />operation will be from 6:00 am to 6:00 pm. The preschoo]/daycaze will offer Spanish language <br />and cultural instruction. <br />The Applicant proposes to locate the daycaze/learning center in a multitenant building on the <br />northea3t comer of Bunke; Lake Boulevard and Dysprosium Street NW. The tenant space at this <br />location is 2,942 square feet, and will be made up of four (4)•classrooms, three (3) restrooms, a <br />staff lounge, and office area. Using the Minnesota Department of Health's formula to determine <br />maximum occupancy for a daycare center, the proposed tenant space on the subject property <br />would allow for roughly sixty-two (62) children (2,200 square feet of classroom space @ 35 . <br />squaze feet per child). <br />As a part of the remodel work for the daycare/preschool, the Applicant is also proposing to <br />create a playground azea on the west side of the building. The playground will be constructed on <br />existing pazking•lot space. The play azea will be enclosed with six by eight foot treated timbers, <br />with grooves cut into them for drainage. This area will then be filled in with playground mulch <br />and surrounded by a chain link fence. The resulting play azea will be approximately 2,000 <br />square feet, exceeding the state requirement of 1,500 squaze feet. <br />The subject property is zoned Planned Unit Development. The PUD for this subdivision <br />specifies that the Subject Property shall be allowed the uses under the B-1 Gerieral Business <br />District and daycare centers are listed as a conditional use in this district. There will be a total of <br />nineteeiu (19) pazking~ stalls on this property (however three will be reserved for use by the <br />adjoining dentist's office). There aze no specific parking requirements in City Code for daycare <br />centers, but there appears to be ample pazking for. this use. <br />
