Mapleton City, 2010 <br />UT 11, 2010 WL 668768 (Utah 2010) <br />UTAH (01/26/10)-This case addressed the issue of whether a city <br />council's adoption of a new zoning classification was subject to refer- <br />endum vote by the citizens. <br />The Backgronnd/Facts: Dr. Wendy A. Gibby and Trudy Gibby <br />(collectively, "Gibby") owned 118 acres of land "near the toe of Ma- <br />ple Mountain" in the city. Gibby wanted to develop this land, but <br />had begn involved in extensive litigation with the city for years over <br />various issues, including permitting and zoning concerns. <br />Eventually, in May 2007, Gibby and the city entered into a settlement <br />agreement that was intended to resolve all disputes between the parties. <br />Under the settlement agreement, the city agreed to rezone between 60 <br />and. 80 acres of Gibby property from Critical Environment (CE-1) to <br />( ~~ <br />(~ <br />WESTo <br />670 Opperman Orive • P.O.
