Zoning Bulletin April 10, 2010 ~ Volume 4 ~ No. 7 <br />Zoning News from Around the Nation <br />CALIFORNIA <br />An Alameda County judge recently ruled that Pleasanton's "voter- <br />approved cap on the number of.residences in the city, a measure in- <br />tended to limit growth and congestion in the town, violates a state <br />law requiring all cities to take on their share of regional housing <br />needs:" The judge "ordered the city to disregard the limit and re- <br />move regulatory barriers. to construction of about 4,000 new housing <br />units by 2014." Of those units, at least three-quarters "must be af- <br />fordable for low- to moderate-income residents." <br />Source: San Francisco Chronicle; www.sfgate.com <br />KENTUCKY <br />The state House recently passed abill-HB 431-that would in- <br />crease the minimum fines for'those who violate city or county zoning <br />laws. Under the bill, fines would range from $100 to $500. The County Council al- <br />ready approved zoning for the casino, but a county law allows voters <br />a referendum on bills passed by the Council if a sufficient number of <br />petition signatures are gathered. <br />Sourcei The Washington Post; httpa/voices.washingtonfiost com/ <br />NEW JERSEY <br />The New.Jersey Assembly recently passed legislation "that would- <br />limit how much towns and cities can alter real estate development rules <br />once projects aze filed." The legislation has already been approved by <br />the Senate, and now awaits a decision by Governor Christie. If signed <br />by the Governor the new law would require the zoning code that is <br />in effect at the time a developer files a project govern the project until <br />I i completion. "Under current law, a developer must abide by any chang- <br />-/ es made to the zoning code between the time an application. is filed and <br />a final decision is made by a municipality."
