Circuit has jurisdiction over Connecticut, New <br />York, and Uermorzt. <br />UNITED STATES .COURT OF APPEALS, SECOND CIRCUIT <br />j (NEW YORK) (03/10/10)-This case addressed the following is- <br />sue: Should the evaluation of whether an ordinance violates the First <br />Amendment be based on "the `alternative avenues of communication' <br />it leaves open at": (1) "the time it is passed"; or (2) the "the time it is <br />challenged." <br />The Background/Facts: In 1994, the -town enacted a zoiung ordi- <br />nance (the "Ordinance") that limited any new "adult entertainment <br />uses" to three kinds of zoning districts: shopping center business <br />("SCB"), lighf industry ("LI"), and heavy industrial ("HI").
