Since 1995, the City has processed approximately twelve (12) variance request related to placement of <br />detached accessory structures in the front yard. The City has also processed multiple requests to OHW <br />setbacks for principal structures during that time period as well. A majority of the Variance requests <br />originated from the Bowers Drive neighborhood, as many of these parcels were subdivided prior to the <br />Critical Area Overlay District being established. The number of these requests has increased since 2006. <br />Based on the number and history of approval of these Variance requests by the Board of Adjustment, <br />especially along Bowers Drive, Staff feels it prudent to explore amending code to match the spirit and <br />intent of these prior approvals by allowing detached accessory structures to be located nearer the front <br />property line than the principal structure if located in either of these two overlay districts. It would be <br />proposed that the detached accessory structure would still need to meet the underlying front yard setback <br />of either 30 feet or 40 feet, depending on the zoning district. <br />Additionally, Staff has also been approached regarding changing the overall regulations for accessory <br />structures with regard to size and architectural standards. Currently there is a limit on size and an overage <br />requires a conditional use permit (CUP). One option could be to allow larger structures without a CUP <br />provided that the exterior materials match that of the existing home. This would allow property owners <br />greater flexibility and less administrative processes to be processed. However, past history of CUP <br />approvals for accessory structures on the larger end of the spectrum have shown a tendency to evolve in <br />to larger scale home occupations.
