Minnesota Electrical Act: Minnesota Statutes Sections 3266.31 to 3266.399; Minnesota Statutes Sections <br />3266.081 to 326B.399: Enforcement; Minnesota Rules Chapters 3800 and 3801 <br />Page 33 of 57 <br />(d}The assessment, of a penalty does not preclude the use of other enforcement provisions, under which <br />penalties 'are not assessed, in connection with the violation for which the penally was assessed. <br />326B.084.FALSE INFORMATION. <br />A person subject to any of the requirements in the applicable law may not make a false material statement, <br />representation, or certification in; omit material information from; or alter, conceal, or fail to file or maintain a <br />notice, application, record, report, plan, or other document required under the applicable law. <br />3266.085 RECOVERY OF LITIGATION COSTS AND EXPENSES. <br />In any action brought by the commissioner for enforcement of an order issued under section 326B.082 for <br />injunctive relief, or to compel performance pursuant to the applicable law, if the state finally prevails, the state, <br />in addition to other penalties provided by law, may be allowed an amount determined by the court to be the <br />reasonable value of all or part of the litigation expenses incurred by the state. In detemnining the amount of the <br />litigation expenses to be allowed, the court shall give consideration to the economic circumstances of the <br />defendant. <br />
