Case #3 <br />CONSIDER COR HOT LIST <br />By: Heidi A. Nelson, HRA Executive Director <br />Background: <br />Development Manager Lazan will present the COR Project "Hot List" for consideration by the <br />HRA. Per the Development Management Contract with Landform, as described in the contract <br />language below, the HOT List must be presented to and approved by the HRA. Portions of this <br />discussion will be held in closed session. <br />1. Hot List <br />a. Active deals will be declared approved, and tracked through a "Hot List" <br />incorporated into the active Dashboard. This list will be presented to the <br />HRA at regular meetings for its approval. No active deal will be <br />considered for placement on the Hot List unless there has been sufficient <br />interest in the development by the subject developer, as determined by the <br />HRA. The Hot List will have no binding effect if it has not received formal <br />approval of the HRA. In the event of termination of this Agreement, the <br />current Hot List will be finalized and approved by all parties. <br />The importance of establishing the "Hot List" is that it entitles the Development Management to <br />compensation even after termination of the contract, in recognition of their efforts in bringing <br />these projects forward. A sliding scale is included in the contract that provides full <br />compensation up to one year, 80% compensation up to two years, 60% up three years, 40% up to <br />four years, 20% up to five years, and no compensation after five years. <br />Staff Recommendation: <br />Receive presentation of COR Project Hot List and approve active deals, according to <br />Development Management contract, for the Hot List. <br />HRA Action: <br />By motion, approve active deals for the COR Project Hot List. <br />Reviewed by: . <br />HRA Executive Director: <br />06/15/10 <br />
