<br />been issued a Certificate of Compliance from the Minnesota Department of Human Rights. The <br />City is under no obligation to delay the award and execution of a contract until a Proposer has <br />completed the human rights certification process. It is the sole responsibility of a Proposer to <br />apply for and obtain a human rights certificate prior to contract award and execution. <br /> <br />18. Subcontracting (FT A Funding) <br /> <br />Proposers may subcontract for functions to fulfill the obligations of their proposal. All Proposers <br />MUST complete and include the attached Subcontractor Information Form with their <br />proposal, even if no subcontractors are proposed to be used on this project. Proposers must <br />indicate on the form either: <br /> <br />1) that no subcontractors will be used on this project; or <br /> <br />2) the name, address, and telephone number of a) each subcontractor proposed to be <br />used on the project AND b) each subcontractor who submitted a bid or quote for the <br />project but was not selected by the Proposer. <br /> <br />Proposers must also complete and execute the certification on page two of the form. (See <br />Attachment to the Proposal Instructions: Subcontractor Information Form) <br /> <br />19. Certification of Non-Debarment (FTA or PFA Funding) <br /> <br />Proposers must sign and submit with their proposals the Certification Regarding Debarment, <br />Suspension, Ineligibility and Voluntary Exclusion attached to this RFP. <br /> <br />20. Lobbying Restriction Certification (FTA or PFA Funding) <br /> <br />The Proposer must comply with the Byrd Anti-Lobbying Amendment, 31 U.S.C. 1352(b)(5), and <br />49 CFR part 20, which provide restrictions on lobbying with federally-appropriated funds and <br />impose disclosure requirements for lobbying with non-federal funds. The Lobbying Restriction <br />Certification attached to this RFP must be completed and submitted with proposals equal to or <br />exceeding $100,000. The certification and disclosures are material representations of fact upon <br />which the City will rely in awarding the contract. Upon award of any subcontracts or supply <br />contracts equal to or exceeding $100,000 under the contract, the successful proposer will be <br />required to obtain the same certification from its subcontractors and suppliers and forward the <br />certification and any disclosures to the City. <br /> <br />Instructions for Preparation of Proposals <br />Page 14 <br />
