<br />must be made in writing to the RFP Administrator, by certified mail, with a copy to the Office of the <br />City Attorney, and shall include a clear reference to the decision to be reviewed and shall state the <br />legal and factual reasons for disagreement with the RFPAdministrator's decision. <br /> <br />Upon receipt of a timely request for Panel Review, the RFP Administrator will convene a review <br />panel. The review panel will consist of the RFP Administrator and two neutral panel members <br />appointed by the RFP Administrator. In the event the RFP Administrator is unavailable or unable to <br />serve on a timely basis, the City Attorney, and/or an attorney in the Office of the City Attorney <br />designated by the City Attorney, may serve in the place of the RFP Administrator. <br /> <br />The review panel will adopt procedures which, to the fullest extent possible, will provide for the <br />expeditious resolution of controversies and disputes. The review panel shall not be required to hold <br />any hearing, and may take action on the basis of such review and investigation as it deems <br />appropriate in its discretion. The review panel may, as it sees fit, accept further written <br />submissions, take testimony, and/or make a transcript of hearings or proceedings. The review panel <br />will issue a written recommendation to the City Council no later than twenty-one (21) working <br />days after receipt of the request for review. The recommendation will include findings of fact and a <br />recommendation for City action. <br /> <br />City COUNCIL <br /> <br />The review panel's recommendation will be presented to the Council for such actions as it deems <br />appropriate. <br /> <br />Effect on Procurement <br /> <br />The RFP Administrator or the Council, as a matter of their sole discretion, may suspend or proceed <br />with the procurement process, pending the outcome of a protest. <br /> <br />Deviations <br /> <br />In the exercise of his or her discretion, and for good cause adequately demonstrated, the RFP <br />Administrator may waive stated deadlines and/or insubstantial deviations from the requirements <br />herein. <br /> <br />Attachment to the Proposal Instructions: Protest Procedures <br />Page 2-4 <br />
