thence south 0 degrees 29 minutes 11 seconds west a distance of 233.0 feet to the <br />point of beginning of the tract of land to be described -thence north 89 degrees 30 <br />miutes 49 seconds west a distance of 523.0 feet and there terminating -together with <br />all that part of said Southeast Quarter of the Northeast Quarter lying within the <br />circumference of a circle using the aforesaid point of termination as its center and <br />having a radius of 50.0 feet (E) all those certain easements set forth and described in <br />indenture dated June 2, 1969 filed July 10, 1969 in book 830 page 503 as Document <br />No. 324670. <br />(the "Subject Property"). <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 117-53 of the Ramsey City Code on July 1, 2010and that said public hearing was <br />properly advertised, and that the minutes of said public hearing are hereby incorporated as a <br />part of these findings by reference. <br />2. That the Subject Property is approximately 1.72 acres in size, according to Anoka County <br />Property Records and is zoned R-1 Rural Developing. <br />3. That the Subject Property is surrounded by properties also zoned R-1 Rural Developing. <br />4. That the Subject Property has frontage along Olivine Street and 161St Lane. <br />5. That the Applicant is proposing to construct a twenty-six by twenty-six foot (26' x 26') <br />detached accessory building (the "Structure") on the Subject Property. <br />6. That the Applicant has submitted a site plan depicting the Applicant's preferred location, <br />herein attached as Exhibit A. <br />7. That the minimum front. and side yard setback for properties within the R-1 Rural <br />Developing District are forty (40) feet and ten (10) feet, respectively. It appears the <br />Structure will be approximately fifty-four (54) feet from the front property line and <br />approximately Fourteen (14) feet from the side property line, meeting all other setbacks <br />other than being located closer to the front property line than that of the principal structure. <br />8. That MN Rules Chapter 7080 requires a minimum setback of twenty (20) feet between an <br />individual sewage treatment system (ISTS) and a building.. The Structure appears to <br />conform to that setback as the private septic system is located in the rear yard behind the <br />principal structure in the center of the Subject Property. <br />9. That City Code Chapter 105 (Buildings) requires three (3) feet of separation between <br />overhangs of structures without the construction of fire rated walls. <br />RESOLUTION #10-07-_ <br />Page 2 of 6 <br />N <br />
