City Engineer Himmer responded with the pond the issue was groundwater and this was not a <br />City of Ramsey project.. He noted the pond was sized appropriately for the amount of water that <br />went to it. He indicated if it was dug deeper, retaining walls had to be put in or the footprint of <br />the pond had to be expanded. <br />Councilmember Wise asked if some of the material had been moved to Burger King. <br />City Engineer Himmer responded there could be contaminated material capped under the parking <br />area at Burger King, which would need to be removed if the pavement was removed. <br />Tom Dahl, AE Common, representing BNSF summarized the work timeline. He noted the <br />State's deadline was August or it would be turned over to the State Super Fund. <br />Motion by Councilmember Dehen, seconded by Councilmember Jeffrey, to adopt Resolution <br />#10-06-119 adopting Findings of Fact 40870 relating to a request for an Interim Use Permit for <br />grading and mining activities on the property located at 7205 Highway 10 NW and the adjacent <br />railroad right-of-way. <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Dehen, Jeffrey, Look, McGlone, <br />and Wise. Voting No: None. Absent: Councilmember Elvig. <br />Motion by Councilmember Dehen, seconded by Councilmember Jeffrey, to adopt Resolution <br />#10-06-120 approving the request for an Interim Use Permit for grading and mining activities at <br />7205 Highway 10 NW and the adjacent railroad right-of-way contingent upon City staff approval <br />of the water management plan and upon receipt of an executed access agreement between BNSF <br />Railway Company and Dolphin Real Estate Management, LLC, until August 1, 2011. <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Dehen, Jeffrey, Look, McGlone, <br />and Wise. Voting No: None. Absent: Councilmember Elvig. <br />7.02: Consider Charter Commission Recommendation regarding Council -Manager <br />Plan/Mayor-Council Plan of Government <br />City Attorney Goodrich reviewed the staff report. <br />Councilmember Wise stated he wanted to see this go to the voters and he did not like the <br />compromise. <br />Councilmember Look believed this should also to go the voters for their decision. <br />Councilmember McGlone believed taking any authority away from the Council was the wrong <br />move as that authority could not be given back.
