CASE # "'~ p ~ <br />CONSIDER REQUEST TO ENTER INTO AN ENCROACHMENT AGREEMENT TO ALLOW <br />A DETACHED ACCESSORY STRUCTURE WITHIN A DRAINAGE AND UTILITY <br />EASEMENT; CASE OF SCOTT ROTHRUM <br />By: Tim Gladhill, Associate Planner <br />Background: <br />The City has received a request from Scott Rothrum at 15370 Xkimo St NW to erect a detached <br />accessory structure within a drainage and utility easement. The purpose of this easement was to protect a <br />stormwater pond for drainage for the Highlands at River Park 2nd Addition. <br />The City reserves the right to remove the structure at any time in order to continue to ensure the <br />stormwater pond functions properly, at the Applicant's cost. The request has been reviewed by the City <br />Engineer, who has stated that the request would not negatively impact the function of the stormwater <br />,pond as proposed. A DRAFT of an Encroachment Agreement is attached for review. <br />Recommendation: <br />If the City Council is willing to entertain the request, Staff recommends modifying the Site Plan so that a <br />majority of the Structure is located outside of the easement, as there appears to be sufficient space to <br />locate a detached accessory structure outside of the easement in addition to the significant grade change <br />within the easement. <br />Council Action: <br />Motion to approve the Encroachment Agreement, subject to revising the Site Plan to locate a majority of <br />the structure outside of the easement, subject to final review of the City Attorney as to legal form. <br />Review Checklist: ' <br />City Administrator <br />City Engineer <br />CC: 07/13/2010 <br />Attachments: <br />a) Site Location Map <br />b) Site Plan <br />c) .Proposed Encroachment Agreement <br />
