CASE # / ~ ~~ <br />ADOPT FORM OF BALLOT <br />FOR CHARTER AMENDMENT QUESTION <br />By: William K. Goodrich, City Attorney <br />Jo Thieling, City clerk <br />Background: <br />On March 23, 2010, pursuant to the process prescribed by Minn. Stat. §410.12, subd. 5, the <br />Council adopted an ordinance proposing a Charter amendment to the voters. The proposed <br />amendment would continue the Mayor-Council Plan (City Administrator) form of government <br />rather than the Council-Manager (City Manager) form of government which is scheduled to take <br />effect January 1, 2011. Pursuant to the State Statute, the ordinance was referred to the Charter <br />Commission for its review. The Charter Commission, on May 5, 2010, rejected the ordinance <br />and recommended an alternate Charter amendment provision. The Council rejected the Charter <br />Commission's alternate provision. On June 22, 2010 at the City Council work session, the <br />Council, together with input from two Charter members at the meeting and written comments <br />from two other Charter members, discussed the form of the ballot question. <br />The attached sample ballot is the form agreed upon at the June 22 work session. The Council is <br />now being asked to formally "fix" the form of the ballot. Staff has presented the ballot form to <br />Anoka County's Elections Supervisor for review and comment.
