Board Member Levine introduced the following resolution and moved for its adoption: <br />RESOLUTION #10-OS-098 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0868 RELATING TO A REQUEST <br />FROM RANDY BUFFIE FOR A VARIANCE TO SIDE YARD SETBACK IN THE R-1 <br />RESIDENTIAL (RURAL DEVELOPING) DISTRICT AT 16208 COQUINA ST NW <br />WHEREAS, Randy Buffie, hereinafter referred to as the "Applicant," has properly applied <br />for a variance from Section 117-111 (R-1 Residential) of the Ramsey City Code to construct an <br />accessory building seven (7) feet from the side property line (the "Structure") on the property <br />generally known as 16208 Coquina St NW and legally described as follows: <br />That part of the west half of the Northeast Quarter of Section 15 Township 32 Range 25 <br />described as follows: Commencing at southeast corner of said west half, thence north 0 degrees <br />15 minutes 56 seconds west along east line thereof 684.39 feet, thence south 70 degrees 49 <br />minutes 24 seconds west 372.81 feet to point of beginning, thence north 3 degrees 19 minutes <br />37 seconds east 361.48 feet, thence north 0 degrees 15 minutes 56 seconds west 110.11 feet, <br />thence south 89 degrees 44 minutes 04 seconds west 33 feet, thence south 84 degrees 48 <br />minutes 31 seconds west 98.36 feet, thence south 37 degrees 14 minutes 02 seconds west 301 <br />feet, thence southerly to point of beginning, except road subject to easement of record. <br />(the "Subject Property"). <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 117-53 of the Ramsey City Code on May 6, 2010 and that said public hearing was <br />properly advertised, and that the minutes of said public hearing are hereby incorporated as a part <br />of these findings by reference. <br />2. That the Subject Property is zoned R-1 Rural Developing. <br />3. That that Subject Property is approximately 1.46 acres (63,572 square feet) in size, excluding <br />any road easement. <br />4. That the Subject Property is surrounded by properties also zoned R-1 Rural Developing <br />5. That the Applicant is proposing to construct atwenty-four by thirty-four foot (24' x 34') <br />accessory building, or eight hundred and sixteen (816) square feet (the "Structure") on the <br />Subject Property. <br />6. That MN Rules Chapter 7080 requires a minimum setback of twenty (20) feet between an <br />individual sewage treatment system (the "ISTS") and a building. The Structure appears to meet <br />this setback as the ISTS is located in the rear yard behind the existing residential dwelling. <br />
