the City. Since the request is specific to future land use and zoning designations (authority granted to the <br />City through Minnesota Statute 462.357), the document is not required to be signed by the existing <br />Property Owner. Anoka County Parks staff has reiterated that they are only interested in working with <br />willing sellers and does not have the appropriate funding to acquire the parcel in the neaz future. In <br />addition, Anoka County Parks Staff has reiterated that they would not stand in the way of any sale to a <br />third-party if the Property Owner chose. <br />Should the Council choose not to enter into the MOU, the City would need to request a change to the <br />2006 Anoka County Parks Comprehensive Plan, subject to review of the Open Space Commission of the <br />Metropolitan Council. Support from staff from both agencies to amend the plan appears to be low. <br />Without resolution to the issue of the in-holding parcel, the City is left without a valid Comprehensive <br />Plan. The City is required under Minnesota Statute 473.859 to complete a Comprehensive Plan approved <br />by the Metropolitan Council. Failure to adopt a Comprehensive Plan-could result in legal action <br />requesting an injunction to have the Metropolitan Council implement the plan on behalf of the City. The <br />City is not able to process changes in land use designations until the 2030 Comprehensive Plan is <br />adopted.
