3. That the Subject Property is surrounded by properties zoned B-1 General Business and R-1 <br />Residential: NIUSA. <br />4. That the Subject Property located within the Wild and Scenic Overlay District. <br />5. That the Applicant is proposing to construct a parking lot with a ten (10) foot front yard <br />setback (the "Parking Lot") on the Subject Property. <br />6. That the Applicant has submitted a site plan depicting the Applicant's preferred location, <br />herein attached as Exhibit A. <br />7. That the Subject Property is located along an oxbow of the Rum River, and therefore is <br />subject to setbacks to bluff lines and the ordinary high water line. <br />8. That the Subject Property has varying degrees of steep slopes and bluff lines at the rear of <br />the Subject Property. <br />9. That the City finds that .the natural hill and bluff, existence of wetlands, and the river <br />oxbow in the rear of the Subject Property creates an undue hardship in locating the Parking <br />Lot. <br />10. That the Subject Property can/cannot be put to a. reasonable use without the variance. <br />11. That the plight is/is not due to circumstances unique to the Subject Property and isnot <br />created by the Applicant. <br />12. That the Variance will/will not alter locality's essential character <br />13. That economic circumstances alone do/do not create the undue hardship. <br />14. That, if granted, the variance will/will. not impair an adequate supply of light and air to <br />adjacent property. <br />15. That, if granted, the variance will/will not have the effect of allowing a.use that is . <br />prohibited in the applicable zoning district. <br />16. That, if granted, the variance will/will not increase the congestion on the public street. <br />17. That, if granted, the variance will/will not adversely impact the degree of public health, <br />safety and general welfare provided for in the Ramsey City Code. , <br />18. That, if granted, the variance will/will not diminish established property values within the <br />neighborhood. <br />19.
