Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #10-08 <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO <br />EXCEED SIGN RESTRICTIONS AS ESTABLISHED IN CITY CODE. <br />WHEREAS, Dolphin Fast Food Inc. properly applied for a conditional use permit to <br />exceed sign size and location restrictions as established in City Code on the property generally <br />known as 7245 Highway 10 NW and legally described as follows: <br />That part of Lot 7 Auditors Subdivision No. 34 Anoka County, Minnesota described as <br />follows: Commencing at the southeast corner Qf said Lot 7, thence northwesterly on the <br />southwesterly line of said Lot 7 a distance of 770 feet, thence north and parallel with <br />the east line of said Lot 7 and to the northeasterly line of said Lot 7, thence <br />southeasterly on said northeasterly line a distance of 200 feet to the point of beginning <br />of land to be described, thence continue southeasterly on the northeasterly line said Lot <br />7 a distance of 150 feet, thence south and parallel with the east line of said Lot 7 and to <br />the southwesterly line of said Lot 7, thence northwesterly on said southwesterly line to <br />a line drawn south from the point of beginning and parallel with the east line of said Lot <br />7, thence north and parallel with the east line of said Lot 7 and to the point of beginning <br />(subject to easement of record if any) <br />("Subject Property") <br />WHEREAS, the Planning Commission met on August 5, 2010, conducted a public <br />hearing, and recommended that City Council approve/deny the request. <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. Based on Findings of Fact # , a conditional use permit ("Permit") to exceed sign size and <br />location restrictions is hereby granted to Dolphin Fast Food Inc. ("Permittee"). <br />2. The Perrnittee is herein granted permission to erect one (1) directional sign on the existing <br />ground sign on the Subject Property. <br />3. The gross surface area of the directional sign shall not exceed sixteen (16) square feet per <br />face (thirty-two [32] aggregate square feet) and the height of the directional sign shall not <br />exceed nine (9) feet above grade (to top of sign). <br />4. The installation of the sign on the Subject Property shall require a sign permit from the City <br />of Ramsey (the "City"). The exact location, height, and configuration of the sign are subject <br />to the approval of the City. <br />11 <br />
