City Council of City of Falls Church, 2010 WL <br />1489982 (Va. 2010) <br />VIRGINIA (04/15/10)—This case addressed the issue of "whether a <br />zoning ordinance, which establishes different building height regulations <br />on one -family dwellings in the same zoning district, violates the [state's <br />uniformity requirement]". <br />The Background/Facts: Anton E.B. Schefer owned 12 lots in the city. <br />All of those lots were zoned R1-B, a medium -density residential district. <br />The minimum lot area requirement for one -family dwellings in the R1-B <br />zoning district was 7,500 square feet. Schefer's lots were less than 7,500 <br />square feet. However, the lots had been lawfully created prior to enact- <br />ment of the 7,500 square feet minimum lot area requirement.
