City Council of City of Falls Church, 2010 WL
1489982 (Va. 2010)
VIRGINIA (04/15/10)—This case addressed the issue of "whether a
zoning ordinance, which establishes different building height regulations
on one -family dwellings in the same zoning district, violates the [state's
uniformity requirement]".
The Background/Facts: Anton E.B. Schefer owned 12 lots in the city.
All of those lots were zoned R1-B, a medium -density residential district.
The minimum lot area requirement for one -family dwellings in the R1-B
zoning district was 7,500 square feet. Schefer's lots were less than 7,500
square feet. However, the lots had been lawfully created prior to enact-
ment of the 7,500 square feet minimum lot area requirement.
