CASE # J <br />Public Hearing <br />REQUEST FOR A CONDITIONAL USE PERMIT TO EXCEED SIGN RESTRICTIONS <br />ON THE PROPERTY LOCATED AT 7245 HIGHWAY 10 NW; <br />CASE OF DOLPHIN FAST FOOD, INC. <br />By: Chris Anderson, Environmental Coordinator <br />Background: <br />The City received an application from Dolphin Fast Food, Inc. requesting an increase in square <br />footage allowed for a directional sign and to deviate from the location requirements of permanent <br />signs to install a directional sign on the adjacent parcel to the west. In accordance with City Code, <br />all variations to the sign regulations are processed with the conditional use permit application. <br />Notification: <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff attempted to notify property owners within 350 feet of the subject <br />property. <br />Observations: <br />The subject property is currently zoned H-1 Highway Business District. The gross surface area of <br />a ground sign is restricted to 100 square feet for each exposed face and shall not exceed an <br />aggregate gross surface area of 200 square feet. Ground signs are limited to one per parcel, and <br />must not exceed twenty-five (25) feet in height. Directional signs are limited to four (4) square <br />feet and a maximum height of five (5) feet. <br />The applicant owns the parcel at the intersection of Ramsey Boulevard and Trunk Highway 10, <br />currently occupied by a Burger King restaurant. The subject property is currently occupied by <br />Pine Ridge Pet Care. In 2001, a reciprocal access agreement was filed with Anoka County <br />granting the applicant access rights from Trunk Highway 10 across the subject property (Pine <br />Ridge Pet Care) and also granting the owner of the subject property access rights to Ramsey <br />Boulevard across the Burger King parcel. <br />The existing ground sign on the subject property, which is situated near the driveway entrance, is <br />fifty-six (56) square feet in size, sixteen and a half (16.5) feet in height, and identifies the Pine <br />Ridge Pet Care business. The applicant would like to install a directional sign that is sixteen (16) <br />square feet in size on the existing ground sign structure indicating access to Burger King from <br />Trunk Highway 10. The proposed directional sign would be installed below the existing signage, <br />about nine (9) feet from grade to top of sign, and thus, would not increase the overall height of the <br />ground sign. <br />The proposed directional sign would be installed on the adjacent parcel from where the service is <br />offered and thus, it would also be classified as a billboard based on the definition of a billboard in <br />City Code, which is, "a sign which directs attention to business, commodity, service, <br />1 <br />
