[...] Nothing herein shall be construed to <br />exclude or prohibit residential or day care facilities from single family zones if otherwise permitted by a local zoning <br />regulation. <br />My question is to confirm that, as proposed, the City shall consider this a residential use under Minn. Stat. 245A which <br />states that a residential program means a program that provides 24-hour-a-day care, supervision, food, lodging, <br />rehabilitation, training, education, habilitation, or treatment outside a person's own home, including a program in an <br />intermediate care facility for four or more persons with developmental disabilities; and chemical dependency or chemical <br />abuse programs that are located in a hospital or nursing home and receive public funds for providing chemical abuse or <br />chemical dependency treatment services under chapter 2458. Residential programs include home and community -based <br />services for persons with disabilities that are provided in or outside a person's own home. I may not be quoting the <br />appropriate areas, so please provide any assistance you can. <br />Even with short term (30 day in -patient), shall the City consider this use residential per Minn.
