introduced the following resolution and moved for its adoption: Councilmember RESOLUTION #10-08- RESOLUTION DECLARING TERMS FOR THE OUTSIDE DISPLAY OF MODULAR HOMES FOR SALE AT 7820 RIVERDALE DR NW WHEREAS, Autumn Leaf Home Builders, Inc. (the "Permittee") has requested to display modular homes for sale (the "Modular Structures") in the B-2 Highway Business District on the property generally known as 7820 Riverdale Dr NW and legally described as follows: Lot 2, Block 4, Alpaca Estates (Subject to Easement as Shown on Plat) (the "Subject Property") AND WHEREAS, the City Council considered the request on August 9,2010; and WHEREAS, the Subject Property is zoned B-2 Highway Business; and WHEREAS, the adjoining parcels are also zoned B-2 Highway Business and the parcels to the south are zoned R-l Residential (MUSA); and WHEREAS, the outdoor display of items for sale are a permitted use in the B-2 Highway Business District; and WHEREAS, the City finds that the items proposed for display in this instance are unique enough to require special consideration to certain zoning requirements including setbacks and building coverage as a result of the display of the Modular Homes; and WHEREAS, the City finds that this agreement is necessary in order to ensure that the Modular Homes do not become a permanent structure. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That the Permittee shall be allowed to display the Modular Structures for sale on the Subject Property as indicated on the site plan, herein attached as Exhibit A. The Permittee shall not be allowed to construct or otherwise store modular homes that are not for sale on the Subject Property . 2. That the Modular Structures shall not be placed on a permanent foundation. 3. That the landscaping may be established surrounding the Modular Structures to give the appearance of an established yard.
