The Public Hearing closed at 7:30 p.m. <br />Board Business <br />Commissioners discussed the access to the sand point well for maintenance and if it is a <br />hardship. <br />Planning Manger Miller stated the primary difference between this case and the one previously <br />before the Board, is that the maintenance in the other situation was a public health issue, this one <br />is a sand point well used for irrigation purposes only. <br />Discussion ensued regarding preferred locations, hardship reasons for the granting of variances <br />and expansion of the current tin shed. They also discussed the slope and topography of the <br />property as it relates to the locations of the buildings. <br />Motion by Board Member Levine, seconded by Board Member Rogers to adopt resolution <br />adopting findings of fact favorable to the applicant relating to a request for a variance at 16151 <br />Olivine Street NW. <br />Further Discussion: <br />Commissioners discussed the findings of fact and made changes to findings of fact number 23 <br />removing the words "and the associated access for maintenance of an existing sand point well". <br />Board Member Brauer called the question, seconded by Commissioner Hunt. <br />Motion Failed. Voting Yes: Board Members, Hunt, Levine, and Rogers. Voting No: <br />Chairperson Van Scoy, Board Members Brauer, and Cleveland. Absent: Board Member <br />Dunaway. <br />Commissioner Cleveland stated the vote is not in opposition of the homeowner, the Board has to <br />comply with the rules in approving a variance. <br />Chairperson Van Scoy requested each Commissioner to briefly state their reason for their vote. <br />Commissioner Hunt stated access is difficult because of the slope in the land and Commissioner <br />Levine concurred. <br />Chairperson Van Scoy stated topography is not an issue because the slope is not excessive and <br />other locations would still provide access to the buildings. Commissioner Cleveland concurred. <br />Commission Rogers stated topography is an issue and the applicant's proposed site location is an <br />ideal situation. <br />Commissioner Brauer stated he is prepared to change his vote if could be shown how the <br />topography is an issue. He would like to know what degree of a slope is considered a hardship. <br />Board of Adjustment/July 1, 2010 <br />Page 3 of 4 <br />
