( <br />A residential building or portion thereof intended for occupancy by one family including apartments <br />but not including hotels, motels, nursing homes, seasonal cabins, boarding or roominghouses, tourist <br />homes or trailers; or <br />(2) <br />Any structure or portion of a structure, or other shelter designed as short- or long -term living quarters <br />for one or more persons, including rental or timeshare accommodations such as motel, hotel, and <br />resort rooms and cabins. <br />Dwelling. attached, means a dwelling which is joined to another at one or more sides by a party wall. <br />Dwelling, detached, means a dwelling unit not attached to another dwelling or structure. <br />Dwelling duplex, means a dwelling designed exclusively for occupancy by two families having <br />separate kitchen, bathroom, and living spaces. <br />Dwelling, guest cottage or accesso1y gpartment, means a structure used as a dwelling unit that may <br />contain sleeping spaces and kitchen and bathroom facilities in addition to those provided in the primary <br />dwelling unit on a lot. <br />Dwellinz manufactured home, means a structure, transportable in one or more sections, which in the <br />traveling mode, is eight body feet or more in width and 40 body feet or more in length, or, when erected on <br />site, is 320 or more square feet, and which is built on a permanent chassis and designated to be used as a <br />dwelling with or without a permanent foundation when connected to the required utilities, and includes the <br />plumbing, heating, air conditioning, and electrical systems contained therein; except that the term includes <br />any structure which meets all the requirements and with respect to which the manufacturer voluntarily files a <br />certification pursuant to Minn. Stats. §§ 327.31- 327.36. <br />Dwelling multiple Cpartment or condominium), means a building designed with three or more <br />dwelling units exclusively for occupancy by three or more families living independently of each other but <br />sharing hallways and main entrances and exits. <br />Dwelling, sin le family, means a dwelling unit designed exclusively for occupancy by one family. <br />Dwelling, townhouse, means structures that are designed for single household habitation, but have <br />outdoor areas and/or indoor centers that are commonly owned and maintained by a homeowners' association. <br />Townhouses have a minimum of one individual entrance /exit per unit. <br />Dwellinz twinhome or quad, means a building containing two or four attached dwelling units, side -by- <br />side, that share common walls at the lot lines and that are on separate lots and do not utilize a homeowners' <br />association. <br />Additionally, the City Council requested clarification as to whether the Fire Department had the <br />right to enter occupied units to inspect for fire code issues. The Fire Department received a <br />response from the State Fire Marshal's Office as to the issue. If the unit is vacant, not rented, <br />then there is no issue with going in with the owner /manager. The issue of entering a dwelling <br />unit that is under lease has to do with tenant's rights. A tenant must be notified in advance <br />before the owner or an inspector can enter except in an emergency (i.e. water flow, fire, etc.). <br />The Fire Department would have the right to enter a non - rented unit to inspect for fire code <br />violations. The owner /manager could refuse entry to the building completely or to specified <br />areas. In this case, the Fire Department would need to seek an administrative search warrant. <br />According to the Fire Marshal's Office, due to the fact that cities have the right to enforce fire <br />code, this administrative search warrant is not difficult to obtain, provided reasonable notice of <br />date and time. <br />
