-190- <br /> <br />lots that have a slope of less than 2%, a certificate of grading, prepared by a licensed (State of <br />Minnesota), professional land surveyor, must be provided to the City documenting that the <br />flattest grade on the lot is 1% or greater. <br /> <br />16. <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />Cash, Land, and Park Improvements. The Plat is located in the Rum River Recreation <br />District. The procedures and priorities of park improvements to be caused within the existing <br />park spaces were established in the Development Agreement for Highlands At River Park <br />and are based on the total project area of 157 lots as reflected in the preliminary plat <br />approved by the Rmnsey City Council on September 11, 2001. Aside from land dedication <br />equating to 3% of the park dedication requirements due on the Plat, the remaining park <br />dedication requirements were to be met by park improvements equating One Hundred Sixty <br />Two Thousand Eight Hundred Nine Dollars and no cents ($162,809.00) in cash value. The <br />DEVELOPER shall provide the City with documentation identifying the cash value of any <br />park improvements installed to date in Highlands At River Park, Highlands At River Park 2nd <br />Addition and this Plat. The remaining balance between $162,809.00 and cash value of <br />installed park improvements to date shall be provided to the City in the form of a cash <br />payment prior to the City releasing the Plat for recording, unless the CITY and <br />DEVELOPER agree upon additional park improvements to be installed as a part of the <br />Stage I Improvements in this Plat. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />Park Trail Development Fee. The City Council has established a trail development fee in <br />the amount of Four Hundred Seventy Five Dollars and no cents ($475.00) per lot. Aside <br />from the construction of an eight (8) foot wide bituminous trail from the easterly terminus of <br />155th Lane N.W. to Bear Park, all trail obligations have been satisfied. <br /> <br />Sidewalk Construction. The DEVELOPER shall construct and pave, in accordance with <br />CITY standards, a five (5) foot wide concrete sidewalk with pedestrian ramps in locations <br />prescribed by the CITY, not to exceed 5% in grade, along the east side of Waco Street N.W. <br />and the north side of 155th Lane N.W. to connect with the bituminous trail that will extend <br />off the cul-de-sac bulb to the east. The costs associated with sidewalk construction are not <br />eligible as a credit towards the Trail Development Fees and/or Park Dedication requirements <br />due on the Plat. <br /> <br />Tree and Sod Planting Plan. Sodded boulevards, in addition to a front yard tree, are a <br />requirement for each lot in the Plat prior to issuance of a Certificate of Occupancy. The <br />DEVELOPER is required to submit a Plan for CITY approval that identifies existing tree <br />growth within the Plat that will be protected during construction, and identifies the location <br />and species of the new plantings.
