CASE # <br /> <br />INTRODUCE ORDINANCE TO REZONE PROPERTY FROM R-1 SINGLE FAMILY <br />TO R-2 MEDIUM DENSITY RESIDENTIAL; <br /> CASE OF OAK CREEK BUILDERS, INC. <br /> By: Megan Wald, Associate Planner <br /> <br />Background: <br /> <br />Tim Pomerleau of Oak Creek Builders, Inc., has submitted an application requesting the City <br />rezone the property generally located at the comer of Sunfish Lake Blvd. and Alpine Drive, also <br />known as 6251 Alpine Drive, from R-1 Single Family Residential to R-2 Medium Density <br />Residential. The rezoning, coupled with a comprehensive plan amendment and subdivision <br />request, would allow the applicant to develop the property with townhomes. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site Location Map <br />b) Proposed preliminary plat for Alpine Acres 2nd Addition dated May 23, 2003 <br />c) Revised preliminary plat for Alpine Acres 2nd Addition dated June 6, 2003 <br />d) Proposed Findings of Fact <br />e) Proposed Ordinance <br /> <br />Notification: <br /> <br />State law requires that the City notify property owners within 350 feet be notified. <br />attempted to notify property owners within 700 feet of the subject property of the request. <br /> <br />Staff <br /> <br />Observations: <br /> <br />Mr. Pomerleau has an active purchase agreement with the estate holders of the subject property. <br />As you may recall, the applicant is developing the property located to the northeast with <br />townhomes, the proposed Alpine Acres subdivision (consisting of 202 townhome units). Mr. <br />Pomerleau would like to include the subject property as part of the Alpine Acres townhouse <br />subdivision and develop 6 townhome units on the property. <br /> <br />The applicant has submitted the required Comprehensive Plan Amendment application to change <br />the land use designation in the Comprehensive Plan from low density residential to medium <br />density residential. <br /> <br />On June 3, 2003, the Planning Commission conducted public hearings regarding the request for a <br />Comprehensive Plan Amendment to change the land use use designation to medium density <br />residential and the request to rezone the property to R-2 Residential'. <br /> <br />At the public heating, Ms. Kuechle stated her opposition to the comprehensive plan amendment <br />and subsequent rezoning because the previous property owners, now deceased, had told her that <br />they did not want their property developed with anything other than single family homes.
