Motion by Councilmember Elvig, seconded by Councilmember Look, adopt Resolution #10-07- <br />141 to appoint Mr. Peter Tokle of Tokle Inspections, Inc. for contracted electrical inspection <br />services to begin on or near August 1, 2010. <br />Further discussion: Mayor Ramsey stated for him this was a twofold issue, _which was for the <br />Council and staff to be able to have influence over the inspector as well as to save money for the <br />City. Councilmember Jeffrey did not believe the citizens would be mistreated by Mr. Tokle, but <br />he was going to oppose this on principal. He believed that once an RFP closed and there were <br />insufficient applicants, the REP should have been reopened and staff should not have gone out <br />and recruited further applicants. Mayor Ramsey stated staff did not ask Mr. Tokle to make a <br />proposal and Mr. Tokle came in on his own. Councilmember Dehen stated he also would oppose <br />this Not because of Mr. Tokle, but because the City and staff should follow the rules. He did <br />not believe staff should be interviewing anyone in any capacity after an RFP closes, unless it is <br />opened up again. City Attorney Goodrich recommended adding the following wording to the <br />Motion: This motion is contingent on reaching an agreement with Mr. Tokle and/or his <br />corporation detailing the terms of his employment with the City pursuant to the City's standard <br />consultant contract, as approved by the City Attorney. City Attorney Goodrich reviewed the <br />agreement. Mr. Richard Kruger, 7640 150`h Lane NW, believed the City electrical and fire <br />departments have never got along. He believed contracting out would cause more problems. <br />The Building Official noted the electrical inspector would still be supervised by the City. <br />Mayor Ramsey requested an amendment to the motion, that there be a 30-day notice for <br />termination in the Contract and to have an end date of January 31, 2011 and in the meantime for <br />the City to go out and have another RFP. Amendment failed for lack of a second. <br />Councilmember Wise expressed concern that Mr. Hagfors was not chosen if the City was going <br />to save money. Councilmember McGlone noted no policies or laws had been broken and he <br />commended the staff for what they had done. He noted in an RFP all the City was required to do <br />was to take the lowest qualified bidder and price did not need to be considered. City <br />Administrator Ulrich noted the price had been equalized as the incumbent proposal had He <br />stated if Council chose Mr. Hagfors, the issue of performance and how that would be handled, <br />the Council would need to make some policies for that. Councilmember Dehen believed this set <br />the wrong precedence. <br />Motion (with contingent verbiage from City Attorney) carried. Voting Yes: Mayor Ramsey, <br />Councilmembers Elvig, Look, and McGlone. Voting No: Councilmembers Dehen, Jeffrey, and <br />Wise. <br />7.03: Award Bids for 2010 Street Maintenance Program <br />City Engineer Himmer reviewed the staff report. <br />Councilmember Elvig asked if a change order should be prepared for the $6,000 increase based <br />on the previous discussion. <br />City Engineer Himmer stated this could be done as a Change Order. <br />City Council / July 13, 2010 <br />Page 8 of 12 <br />P18 <br />
