Chairperson Van Scoy introduced the following resolution and moved for its adoption: <br />(the "Subject Property "). <br />RESOLUTION #10 -08 -158 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0872 RELATING TO A REQUEST <br />FROM JOHN C. WEICHT AND ASSOCIATES, LLP FOR A VARIANCE TO PARKING <br />LOT SETBACKS AND NUMBER OF PARKING SPACES <br />WHEREAS, John C Weicht and Associates, LLP, hereinafter referred to as the <br />"Applicant," has properly applied for a variance from Section 117 -349 (Off - Street Parking) of <br />the Ramsey City Code to construct parking lot within ten (10) feet of the front property line on <br />the property generally located near the southeast corner of Xkimo Street and 142 Avenue and <br />legally described as follows: <br />That part of Govt Lot 3, Section 25, Township 32, Range 25 described as follows: <br />Commencing at a point on centerline of St. Francis Blvd. 480 feet northwesterly (as <br />measured along said centerline) from its intersect with south line of Govt Lot 6, Section <br />36, Township 32, Range 25, thence northwesterly along said centerline 250 feet, thence <br />northeasterly at right angle from said centerline 350 feet, thence northwesterly along a <br />line hereafter known as line A, parallel with said centerline 1100 feet to point of <br />beginning, thence north 67 degrees, 21 minutes 17 seconds to easterly right of way line of <br />Waco Street, thence easterly along southerly line of Lot 4, Block 2 Rivers Bend 2nd <br />Addition to southeast corner of said lot, thence northerly along easterly line of said Block <br />2 to southerly line of Rivers Bend, thence easterly along said southerly line to the thread <br />of Rum River, thence southerly along thread of said river to south line of said Govt Lot 3, <br />thence westerly along said south line to said line A thence northerly along said line A to <br />point of beginning together with that part of said . Govt Lot 3 described as follows: <br />beginning at said point of beginning, thence south 67 degrees 21 minutes 17 seconds west <br />along line C to said centerline, thence southeasterly along said centerline to intersect with <br />a line parallel with and 66 feet southeasterly of said line C, thence northeasterly along <br />said parallel line to said line A, thence northwesterly along said line A to point of <br />beginning; except road subject to easement of record. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 117 -53 of the Ramsey City Code on August 5, 2010and that said public hearing <br />was properly advertised, and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br />2. That the Subject Property is approximately 3.08 acres in size, and is zoned R -3 Residential. <br />
