Councilmember McGlone introduced the following resolution and moved for its adoption: <br />-and- <br />RESOLUTION #10 -06 -133 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0871 RELATING TO A <br />REQUEST FROM DORIS GRIEP, EL GATO CON BOTAS LEARNING CENTER, TO <br />OPERATE A DAYCARE IN THE B -1 GENERAL BUSINESS DISTRICT ON THE <br />PROPERTY LOCATED AT 5400 140 AVE NW <br />WHEREAS, the City of Ramsey (the "City ") received an application from Doris Griep <br />on May 13, 2010 for a Conditional Use Permit to operate a daycare facility in the Planned Unit <br />Development (PUD) District on the property generally known as 5400 140 Avenue NW and <br />legally described as follows: <br />That part of Lot 1, Block 1 Mallard Ponds 2" Addition lying within the Northwest <br />Quarter of the Northwest Quarter of Section 36, Township 32, Range 25, subject to <br />easement of record, Anoka County, Minnesota <br />That part of Lot 1, Block 1 Mallard Ponds 2nd Addition lying within the Northwest <br />Quarter of the Northwest Quarter of Section 36, Township 32, Range 25, subject to <br />easement of record, Anoka County, Minnesota <br />(the "Subject Property ") <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That on May 13, 2010, Doris Griep, hereinafter referred to as the "Applicant," <br />properly applied for a Conditional Use Permit (the "Permit ") to operate a daycare <br />facility on the Subject Property. <br />2. That the Applicant appeared before the Ramsey Planning Commission for a public <br />hearing pursuant to Section 117- 51(b)(3) of the City Code on June 3, 2010 and that <br />said public hearing was properly advertised and that the minutes of said public hearing <br />are herby incorporated as a part of these findings by reference. <br />3. That the Subject Property is zoned Planned Unit Development, which specifies that <br />the Subject Property will be allowed the uses under the B -1 General Business District. <br />4. That daycare centers are permitted only as a conditional use in the B -1 General <br />Business District. <br />5. That the proposed daycare facility will be located in a multitenant building. <br />
