The public hearing was closed at 7:20 p.m. Council Business Mayor Ramsey called the regular City Council meeting back to order at 7:20 p.m. 7. COUNCIL BUSINESS 7.01: Request for a Conditional Use Permit to Exceed Sign Restrictions on the Property located at 7245 Highway 10 NW; Case of Dolphin Fast Food, Inc. Planning Manager Miller reviewed the staff report. Motion by Councilmember Look, seconded by Councilmember McGlone, to adopt Resolution #10 -08 -191 adopting Findings of Fact #0874 relating to Dolphin Fast Food, Inc.'s request for a conditional use permit to exceed sign restrictions outlined in City Code and to approve Resolution #10 -08 -192 approving Dolphin Fast Food, Inc.'s request to exceed sign restrictions at 7245 Highway 10 NW and declaring terms of same contingent. Further discussion: Councilmember Dehen inquired about setting precedent and how far would it extend. City Attorney Goodrich responded this needed to be addressed on a case -by -case basis and look at the unique circumstances. He did not believe this would be precedent setting. Councilmember Elvig asked if the sign was large enough to make people realize the entrance was there. He asked if this would work. He requested this be added to the Findings of Fact that it was a public safety issue. Kurt Kiel, Representative of Dolphin Fast Food, responded he believed the sign would be large enough Planning Manager Miller noted finding number 25 did address the safety issue. She noted the reason the sign could not get larger was because of site line issues with it being any closer to the ground. Councilmember McGlone called the question. Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Look, McGlone, Dehen, Elvig, and Wise. Voting No: None. Councilmember Jeffrey. 7.02: Introduce Ordinance to Amend Article Fourteen (Rental Residential Dwelling Units) of Chapter Twenty Six of City Code; Case of City of Ramsey Planning Manager Miller reviewed the staff report. Mayor Ramsey stated he did not believe the City should burden someone who had two properties in the City. He indicated he understood if someone owned multi - family structures who were attempting to make a living should have to obtain a license.
