CASE # _�, 0 - RECEIVE PROPERTY OWNER PETITION FOR UTILITY AND ROADWAY IMPROVEMENTS TO SERVE THE PROPOSED LEGACY CHRISTIAN ACADEMY, AND AWARD A CONTRACT TO PERFORM THE FEASIBILITY STUDY FOR SUCH IMPROVEMENTS By: Tim Himmer, City Engineer Background: Staff has been working on the review of development applications for a proposed K -12 school project to be located west of Armstrong Boulevard on a roadway extension of Bunker Lake Boulevard. On September 23, 2010 a petition was received requesting utility and roadway improvements to serve this project (see attached letter). The request is to have the City design, construct, and assess the improvements to the properties, as proposed in the ALPHA DEVELOPMENT preliminary plat, as the sole beneficiaries under Minnesota Chapter 429. Staff has verified that the petition has the correct signatures of the property owners, and the City Attorney will be performing a title search to determine if there are other encumbrances on the property that may be affected. A majority of the project costs are anticipated to be special assessed to the benefitted properties, with the cost of extra depth and over - sizing of the utilities that would serve the larger service area to the north and west being paid through the appropriate utility funds. Due to the tight timeline to advance this project staff has solicited quotes from 3 consulting firms to perform the feasibility study; outlining the project scope, estimated costs, and financing. Quotes are due to the City on Friday October 8th and will be forward to the Council via e -mail or the City's ftp site. Construction of this project is anticipated to take place in the spring/summer of 2011, most likely in conjunction with the planned signalization project of the Armstrong Boulevard and Bunker Lake Boulevard intersection. Recommendation: It is the recommendation of staff to accept the infrastructure improvement petition and award a contract to XXX in the amount of $XXX to prepare a feasibility study for the requested improvements. Funding Source: The Cost for the preparation of the feasibility study will be paid by the property owner /applicant, and they will be required to deposit the contracted dollar amount with the City.
