CASE # _�, 0 - <br />RECEIVE PROPERTY OWNER PETITION FOR UTILITY AND ROADWAY <br />IMPROVEMENTS TO SERVE THE PROPOSED LEGACY CHRISTIAN ACADEMY, <br />AND AWARD A CONTRACT TO PERFORM THE FEASIBILITY STUDY FOR SUCH <br />IMPROVEMENTS <br />By: Tim Himmer, City Engineer <br />Background: <br />Staff has been working on the review of development applications for a proposed K -12 school <br />project to be located west of Armstrong Boulevard on a roadway extension of Bunker Lake <br />Boulevard. On September 23, 2010 a petition was received requesting utility and roadway <br />improvements to serve this project (see attached letter). The request is to have the City design, <br />construct, and assess the improvements to the properties, as proposed in the ALPHA <br />DEVELOPMENT preliminary plat, as the sole beneficiaries under Minnesota Chapter 429. Staff <br />has verified that the petition has the correct signatures of the property owners, and the City <br />Attorney will be performing a title search to determine if there are other encumbrances on the <br />property that may be affected. A majority of the project costs are anticipated to be special <br />assessed to the benefitted properties, with the cost of extra depth and over - sizing of the utilities <br />that would serve the larger service area to the north and west being paid through the appropriate <br />utility funds. <br />Due to the tight timeline to advance this project staff has solicited quotes from 3 consulting firms <br />to perform the feasibility study; outlining the project scope, estimated costs, and financing. <br />Quotes are due to the City on Friday October 8th and will be forward to the Council via e -mail or <br />the City's ftp site. Construction of this project is anticipated to take place in the spring/summer <br />of 2011, most likely in conjunction with the planned signalization project of the Armstrong <br />Boulevard and Bunker Lake Boulevard intersection. <br />Recommendation: <br />It is the recommendation of staff to accept the infrastructure improvement petition and award a <br />contract to XXX in the amount of $XXX to prepare a feasibility study for the requested <br />improvements. <br />Funding Source: <br />The Cost for the preparation of the feasibility study will be paid by the property owner /applicant, <br />and they will be required to deposit the contracted dollar amount with the City. <br />
