Mayor Ramsey introduced the following resolution and moved for its adoption: <br />RESOLUTION #10 -08 -193 <br />RESOLUTION PROVIDING COMMENTS TO FIRST DRAFT OF MISSISSIPPI RIVER <br />CORRIDOR CRITICAL AREA (MRCCA) RULES <br />WHEREAS, in 2009, the Minnesota Legislature directed the DNR to establish districts <br />within the MRCCA, minimum guidelines for standards in the districts, take into account <br />municipal plans and policies as well as existing ordinances and conditions; and <br />WHEREAS, the rulemaking requires the DNR to establish districts within the MRCCA, <br />minimum guidelines for standards in the districts, take into account municipal plans and policies <br />as well as existing ordinances and conditions; and <br />WHEREAS, as part of the rulemaking process, working groups were established of 15- <br />20 people set to convene three or four times from March 2010 to September 2010; and <br />WHEREAS, the City has participated in these working groups and has had the <br />opportunity to review and comment the proposed rules; and <br />WHEREAS, the City understands the importance of the key resource that is the <br />Mississippi River and that additional protections may be warranted. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the City requests that the DNR not require of the City to be placed in both the Wild <br />and Scenic and MRCCA Overlay. <br />2) That the City requests that the DNR only implement the minimum standards in order to <br />protect the health, safety, and welfare of the MRCCA in compliance with the Executive <br />Order implementing the MRCCA and provide evidence as to the minimum standards. <br />3) That the City approves of the tiered land use district approach. <br />4) That the City requested additional protections, possibly a separate land use district, for <br />those parcels already develop that may be impacted by lawful, non - conforming statuses <br />above and beyond what is provided in MN Statute 462.357. <br />5) That the City requests that the Metropolitan Council be involved to a greater degree to <br />ensure continuity between approved comprehensive plans and MRCCA plans in that <br />
